Filing a Counter-Notification to Restore Removed Content

We process all removal notifications in good faith based on the acceptance of submissions from the party who submitted the removal notification. We do not verify the actual content before deletion due to a complaint

If you believe that access to a file that you have uploaded has been incorrectly disabled due to an incorrect removal request, you may submit a counter notification.

You should file a counter-notification only if you are certain that no other party owns the copyright to the material, or you have the right to store the material, and if you share it, that you have the right to distribute it.

Please have understanding, that:

If you file a counter-notification, we will forward it for clarification along with your address and other contact information to the party that issued the original copyright infringement notice. By submitting your counter-notification, you authorize us to disclose the information you provided in your notification to the party who filed the copyright infringement notice.

The filing of a counter-notification may lead to a dispute, as well as a lawsuit against you and the complaining party.

It may result in adverse legal consequences for you in the country of the copyright owner and / or the jurisdiction of your country if you make false or bad faith claim with this process. You may be held liable for damages under Section 512 (f) of the Copyright Act, 17 U.S.C. Section 512 (f), which states that a person who knowingly misrepresents that a material is in violation of copyright law may be liable.

If you use the counter-notification process to make a false or bad faith claim or otherwise violate these terms or any of our policies, if you incur any losses, costs (including attorney's fees), financial damages, we reserve the right to charge you for the costs incurred by your false claims, by deducting the balance on your account and / or initiate a lawsuit against you in the jurisdiction of your country.

We voluntarily offer a counter-notification process to assert claims of the rights holders, while we do not submit to any other jurisdiction, law or court other than that of the Republic of Cyprus as set out in this policy.

We may change, suspend or revoke a counter-notification at any time, provided that the contra-indications on the train continue to be processed at that time.

By submitting a counter notification, you accept the above conditions. If you do not accept the above conditions, you must not submit a counter notification.

In order to file a counter-notification with us, you must provide a written notice using the contact form that contains the following information:

  1. Identify the specific URLs of material that has been removed or has been disabled.
  2. Username of your user account at Filerazer, your full name, address, phone number and e-mail address.
  3. The statement: "I have a good faith belief that the material has been removed or disabled due to an error or misidentification of the material."
  4. An explanation for the person who sent the removal request, why this removal request was incorrect.
  5. The Declaration "I accept the service of proceedings in the Republic of Cyprus or in the jurisdiction in which my address is located in the counter-notification from the person who provided Filerazer with the original copyright infringement statement or a representative of that person."
  6. Signature. A scanned physical signature or signature in an e-mail or web form will be accepted.
  7. You may also add comments to your counter-notification.

We only accept a counter-notification that comes directly from the user in whose account a URL or file has been disabled.

For verification purposes, an e-mail address associated with the account must be submitted when completing the counter-notification.

If we do not receive any further communication from or on behalf of the person who originally filed the copyright infringement notice, or the statement we receive does not adequately justify the original copyright infringement notice, we may, but are not obligated, unlock and / or release the affected material within the next 14 days.

Regardless of a submission of a counter-notification, we reserve the right to delete any file at any time without prior notice, or stating any reason.
